My SPOT Loyalty Programme – Terms and Conditions
My SPOT Loyalty Programme Rules and Terms and Conditions
RULES AND REGULATIONS OF THE “My SPOT” LOYALTY PROGRAMME
The SPOT mobile application (the “Application”) is owned by NE Property B.V. (the “Company”), which has the right to use it at Forum Gdańsk Property Sp. z o.o. (the “Shopping Centre”) as part of the NEPI Rockcastle Group, with its registered office in Warsaw at 4 Twarda Street, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under KRS number 0000428845, NIP 5833154089 and REGON 221718746.
The SPOT mobile application consists of software accessible on both iOS and Android operating systems. It is available free of charge from the App Store and Google Play and provides Users with a range of services, as well as loyalty points entitling Users to rewards and discounts on products and services offered at the Shopping Centre.
The purpose of these Rules and Regulations is to provide Users, as defined in the Terms of Use, with full and accurate information about the conditions governing participation in the “My SPOT” loyalty programme (the “Loyalty Programme”).
By downloading the Application and joining the My SPOT loyalty programme, the User accepts and agrees to comply with the Loyalty Programme Rules and Regulations.
To use the Application, it must be installed on a mobile phone or tablet running iOS or Android. The mobile application may only be used after the User has accepted the Terms of Use currently in force.
The benefits granted are updated periodically in the Application. The Shopping Centre reserves the right to amend the Terms of Use and/or Privacy Policy, as well as the Rules and Regulations governing participation in the My SPOT loyalty programme, at any time.
1. THE My SPOT LOYALTY PROGRAMME
1. General Information
These terms describe the My SPOT loyalty programme. Detailed information about the programme, including the latest updates, is provided in the programme details section. These details may be amended periodically; therefore, Users are asked to check them regularly to stay informed of the latest information.
My SPOT is a loyalty programme integrated into the SPOT mobile application.
My SPOT is based on a loyalty points collection mechanism under which points are awarded for purchases made at stores in shopping centres participating in the programme. The Loyalty Programme has the following structure:
Benefits based on the status achieved by the User in the Application, including discounts and exclusive benefits.
The ability to redeem loyalty points collected in the Application for rewards and services.
2. Eligibility and Registration
The My SPOT programme can be accessed through the “My SPOT” section. To join the Loyalty Programme, Users must register by creating a user account in the Application.
3. LOCATION
The mobile application is available across the portfolio of NEPI Rockcastle shopping centres. The list of shopping centres participating in the My SPOT loyalty programme can be found in Appendix 1 to the Terms of Use.
Users may select in the Application the main shopping centre they visit most frequently. They may also select another shopping centre when visiting other NEPI Rockcastle shopping centres in Poland, whether when travelling outside their home town or simply visiting a different centre.
Users may collect points for purchases made at any participating shopping centre. Users may also redeem points and enjoy the benefits associated with their status at any one of the shopping centres participating in the programme.
The current terms of the Loyalty Programme apply to Forum Gdańsk Shopping Centre (hereinafter the “Shopping Centre”), located at 7 Targ Sienny Street, Gdańsk, postal code 80-806.
4. HOW TO COLLECT POINTS
4.1. Earning Points
Users earn points for purchases made at stores in shopping centres participating in the programme, at a rate of PLN 1 = 1 point. The stores listed in Section 3.3 are excluded from this rate.
Users may also earn points for the following activities performed in the Application:
Creating an account in the Application (Registration): 100 points.
Completing the profile in the “My Account” section: 100 points.
Recommending the SPOT application to a friend: The User may send an invitation code to friends. The User will receive 100 points when the invited friend creates an account in the Application using the invitation code. The User may receive a maximum of 500 points per year.
For the first voucher scanned by a friend invited to the Application: The User receives 100 points. The User may receive a maximum of 500 points.
Checking in at the Shopping Centre: Users may check in at the Shopping Centre a maximum of twice per week and earn a maximum of 200 points per month. Each check-in is worth 20 points.
Scanning a receipt from a purchase made at the Shopping Centre: The User receives 1 point for every PLN 1 spent, subject to the following exceptions:
1 point for every PLN 5 spent at a supermarket, hypermarket or other grocery store listed in Section 3.3(i).
1 point for every PLN 5 spent at an electronics store listed in Section 3.3(ii).
4.2. Point Accumulation Methods
Participants may choose one of the following methods of collecting points:
Collecting points by manually scanning receipts in the Application; or
Automatically collecting points by synchronising a bank account with the account in the Application.
Participants may use only one of the above methods of collecting points at a time. Participants may change their point accumulation method at any time, but no more than once per day.
Collected points cannot be exchanged for cash. Each User may access a range of benefits depending on the membership level they have achieved at the relevant time.
4.3. Converting Purchase Receipts into Points
Converting purchase receipts into points: For purchases made at the Shopping Centre, Users receive loyalty points by scanning their receipt using the receipt-scanning module available in the SPOT Application.
Standard conversion rate: Every PLN 1 spent earns 1 point (PLN 1 = 1 point), subject to standard mathematical rounding rules.
Exceptions:
Purchases at hypermarkets, supermarkets or grocery stores: every PLN 2 spent earns 1 point (PLN 2 = 1 point), subject to standard mathematical rounding rules.
Purchases at Dyson, Dream Mobile, iDream, Media Markt, Mi Store, Samsung and T Mobile stores: every PLN 5 spent earns 1 point (PLN 5 = 1 point), subject to standard mathematical rounding rules.
The following transactions and purchases earn 0 points:
Currency exchange and precious metal exchange transactions.
Payment intermediary services, including utility bill payments.

Gambling and/or casino-type games.
Gift vouchers purchased at the Infodesk.
Fuel, alcohol, tobacco products, electronic cigarettes, medicines and prepaid cards.

The list of excluded stores is provided in Appendix 3.
Users must comply with the following conditions and restrictions regarding receipt scanning:
Maximum number of receipts scanned per store per day: 2.
Maximum total number of receipts scanned per User: 10 per day and 20 per week.
Maximum number of points that may be earned per month, regardless of the number and value of receipts scanned: 4,500 points.
Minimum accepted value of each receipt scanned: PLN 30.
Deleted.
Maximum period for scanning a receipt from the date of purchase: 2 days (48 hours from the time the receipt was printed).
Maximum number of rewards a User may redeem: 2 per day.
Employees of a Merchant and persons related to them, including spouses, descendants and siblings, may participate in the Programme, provided that they are not entitled to register receipts issued by the Merchant for whom they work.
Users may not lend their accumulated points to other Users or transfer them from one account to another.
Scans of receipts not in the User’s possession, including photographs of receipts, will not be accepted. The User must be the owner of the receipt and the person who paid for the purchase.
As the automatic receipt identification system recognises only fiscal receipts, and in order to prevent fraud, scans other than valid scans of fiscal receipts will not be accepted. Tax invoices, non-fiscal receipts and receipts issued for business purchases that contain the buyer’s tax identification number and are equivalent to invoices will not be considered valid for participation in loyalty programmes offered by the Shopping Centre and/or the Company’s Business Partners.
Each receipt may be registered only once and by only one User. The same receipt may not be registered in the Programme by two different Users. Doing so will be considered a breach of these Rules and Regulations.
Points for scanned receipts may be awarded automatically immediately after scanning. If there is any uncertainty regarding a scan, the Shopping Centre and/or the Company’s Business Partners reserve the right to review the receipt within up to 3 business days, after which the appropriate number of points will be awarded to the User.
Once the points have been credited, the Application will display the updated point balance on the mobile phone screen in the relevant section.
The number of points already awarded to a User may not be reduced as a result of such a change.
The Shopping Centre and/or the Company’s Business Partners may modify the rewards offered in the “Rewards Catalogue” section of the Application at any time, both in terms of the range of rewards and gifts available and the number of points required for each individual reward. Users will be informed of such changes in the Application.
The Shopping Centre and/or the Company’s Business Partners reserve the right to deduct points obtained by Users through fraudulent activity.
If a User deletes their account or the Company closes the account, any collected and unused points may not be lent to other Users or transferred to other accounts and will be forfeited.
If the Company decides to discontinue the Application, Users will be notified 30 days in advance. Any points not redeemed by the date on which the Application is discontinued will be forfeited.
4. AUTOMATIC POINT ACCUMULATION
As part of the Loyalty Programme, Participants may activate Automatic Point Accumulation as a separate feature of the Loyalty Programme.
The provider of the Automatic Point Accumulation feature (service) is Spaycial/Transaction Connect, a French company with its registered office at 86 Rue du Faubourg Saint-Denis, 75010 Paris, registered with the Paris Trade and Companies Register under number 822 619 185 (“Transaction Connect”).
During registration or at any time after registering for the Programme, a link enabling the activation of Automatic Point Accumulation will be available in the Participant’s account.
When the User (“User who has activated the Automatic Point Accumulation service”) decides to activate Automatic Point Accumulation, Transaction Connect will provide the service. The User will provide Transaction Connect with the following data: bank, account type and any other information that may be required by the relevant Eligible Entity’s branch. The User also consents to synchronising their account with their Loyalty Account in accordance with the terms governing the use of Automatic Point Accumulation.
The Participant undertakes to provide accurate and complete information and to update such information as often as required.
The Participant must reactivate their payment card in the Application every 90 days in order for points to continue to be accumulated automatically using this feature. The User will receive reminders to reactivate the card by email and push notification.
If the User does not reactivate their payment card within 10 days after the expiry of the 90-day period referred to above, their status will be downgraded from VIP to the level corresponding to the number of points collected.
Detailed information on how Automatic Point Accumulation works is set out in the Terms of Use provided by Transaction Connect.
Once Automatic Point Accumulation has been activated, the Participant is granted VIP status.
The Automatic Point Accumulation feature is available and may be activated only for the duration of the Programme.
For the purposes of interpreting and regulating the rules governing Automatic Point Accumulation, the following terms are defined:
a. Eligible Entities – banks admitted to the Programme, meaning any company in Poland or any company with a permanent registered office in Poland, included in the list set out in Appendix 2 to these Rules and Regulations.
Note: At the discretion of Transaction Connect, the entity responsible for Automatic Point Accumulation, any company may be removed from the list of Eligible Entities without the Participant being entitled to compensation or reimbursement of costs.
b. Synchronised Account – an account synchronised with the User’s account. A Synchronised Account may be a bank account.
c. Payment Method(s) – a payment instrument or instruments, i.e. payment card or cards, linked to the Participant’s Synchronised Account. All Payment Methods linked to the Participant’s Synchronised Account will trigger Automatic Point Accumulation for purchases that qualify for points. The User does not need to update their details if their Payment Method changes, for example, if they receive a new payment card.
Activating Automatic Point Accumulation:
a. To activate Automatic Point Accumulation, the Participant:
Must have an active account; and
Must link a bank account to their account, select the relevant financial institution (the bank where the Participant holds an account) and enter, in the secure interface, the same username and password used to access the secure interface for checking their bank account, in accordance with the applicable PSD2 Payment Services Directive. This process results in the synchronisation of the accounts.
Note: The User’s bank, if the User has a bank account designated for synchronisation, must appear on the list of Eligible Entities.
b. The User may earn additional points by making referrals and sharing information available in the Application, including information intended exclusively for VIP Users.
c. Points relating to a Synchronised Account may appear within 7 days of a purchase made at Platan Shopping Centre.
d. Points for purchases made by a VIP User will be automatically credited to their account once a purchase has been made at a Merchant’s premises in Platan Shopping Centre and the transaction has been posted to the bank account.
e. If a VIP account is not refreshed within 90 days of the date of synchronisation or the last refresh, a User paying for purchases at the Shopping Centre will earn points only for the period during which the account is synchronised.
f. In the case of a joint bank account, one bank account may be synchronised with only one account. At the same time, all Payment Methods linked to the joint account will trigger the accumulation of points in the account synchronised with that joint bank account.
g. If Automatic Point Accumulation is activated, payments made from one bank account will not be accepted under another loyalty account.
h. The same purchase may be registered only once and under only one account. The same purchase may not be registered in the Programme by two different Participants. Such conduct will be considered a breach of these Rules and Regulations.
5. EXPIRY OF POINTS
Points awarded before 21 October 2025 remain valid for 24 months from the date on which they were awarded. After this period, the points are automatically cancelled, and the User may not make any claims in respect of them.
From 21 October 2025, all newly awarded points are valid for 6 months from the date on which they are awarded. After this period, the points are automatically cancelled and cannot be reinstated.
6. REDEEMING LOYALTY POINTS
Loyalty points collected in the Application may be redeemed for selected rewards and benefits available at the Shopping Centre, including rewards, shopping vouchers and services, such as parking services, offered at that Shopping Centre.
Users can view the list of rewards and redeem their loyalty points for selected rewards in the “My SPOT – Rewards Catalogue” section. The list of rewards is specific to each shopping centre and can be viewed in the relevant section after the User selects their preferred shopping centre.
Users are not entitled to exchange rewards for cash, other products or other benefits.
Users must retain the original paper receipt for purchases worth at least PLN 150 throughout the current calendar year and for at least 30 business days after the end of that calendar year.
The Organiser reserves the right to verify receipts registered in the Loyalty Programme, particularly when a User redeems a reward worth 10,000 points or more.
During the verification process for the redemption of such a reward, only photographs of original receipts will be accepted. Bank statements, photocopies of receipts and photographs of receipts from the “Points History” section of the Application will not be accepted.
6.1. Paying for Parking with SPOT Points
6.1.1. Users may use their points to pay for a parking ticket. The conversion rate is: PLN 1 in parking fees = 33 SPOT points.
6.1.2. To pay for parking with SPOT points:
Enter Forum Gdańsk car park and collect a parking ticket at the entrance. Park your car.
Open the SPOT Application and select Forum Gdańsk Shopping Centre. Tap the “Parking” icon at the bottom of the Application’s home screen.
Open the “Your Ticket” tab and enter the number of the ticket you collected in the Application. You may enter the number manually or simply scan the ticket.
Your ticket details will appear at the top of the screen. Make sure that all the information is correct.
When you are ready to leave the Shopping Centre and exit the car park, tap the “Pay for Parking Ticket” button. You will be shown your parking duration and the number of points required to pay for parking. As internet access may be limited, we recommend paying for your ticket while you are still inside the shopping centre.
After selecting “Pay with SPOT Points”, the relevant number of points will be deducted from your account and your parking ticket will be validated. You will receive a message confirming that the payment has been successfully registered and will be able to leave the car park. You have 15 minutes to exit the car park.
If you do not have enough SPOT points in your account, you will not be able to pay with SPOT points. In this case, you must pay for the parking ticket at the parking payment machine.
6.1.3. If payment for parking in the Application does not work, the ticket cannot be registered (either by entering the information manually or by scanning the ticket), or the User does not have enough SPOT points in their account, the parking ticket must be paid for at the parking payment machine.
7. POINTS HISTORY
Users can view their collected and redeemed points in the “My SPOT – Points History” section.
8. ACHIEVING SPOT MEMBERSHIP STATUS IN THE APPLICATION
Depending on the number of points collected, Users may achieve one of the following status levels:
BRONZE: Assigned by default upon registration in the Application.
SILVER: Achieved upon reaching the threshold of 5,500 points.
GOLD: Achieved upon reaching the threshold of 12,500 points.
VIP: Granted to a User who has activated Automatic Point Accumulation as part of the Loyalty Programme, i.e. synchronised a bank account with a payment card in accordance with Section 4 of these Rules and Regulations.
Each of these four levels provides access to exclusive benefits and special discounts at partner stores.
9. EXPIRY OF MEMBERSHIP STATUS
Once a User achieves a new status in the Application, that status remains valid for 24 months and is available across all participating NEPI Rockcastle shopping centres in Poland.
The list of shopping centres participating in the Loyalty Programme can be found in Appendix 1 to the Terms of Use.
10. BENEFITS AVAILABLE TO USERS ACCORDING TO MEMBERSHIP STATUS
Depending on the membership status achieved in the Application based on the points collected, Users have access to discounts at partner stores and exclusive benefits.
The benefits granted to Users will be listed in the Application and periodically updated by the Shopping Centre. They may include discounts at partner stores, VIP benefits, preferential services or invitations to events.
Users can view the benefits available to them according to their status in the Application under My SPOT → My Benefits.
Benefits such as discounts, rewards, event invitations and other experiences cannot be exchanged for cash.
Discounts offered as part of the SPOT Programme
Discounts offered as part of the SPOT Programme cannot be combined with loyalty cards issued independently by partner stores. Each My SPOT loyalty programme partner store will decide whether discounts can be combined with other offers or discounts provided by that store. The conditions for accessing discounts will be specified in the “Discounts” section.
Discounts can be redeemed by scanning the barcode generated in the “Discounts” section of the relevant partner store’s offer or by presenting the discount in the Application at the checkout of the store where it is to be used.
11. HOW TO REDEEM OFFERS AND REWARDS
11.1. How to Collect Rewards
To collect rewards redeemed in exchange for loyalty points, Users must follow these steps:
The User selects their preferred reward from the “Rewards Catalogue” section of My SPOT.
If the User has enough points to redeem the reward, whether a product or service, they select it and tap “Redeem Now”.
The selected reward will be reserved for the User.
The User will receive a confirmation email containing information on how to collect the reward, including the name and description of the selected reward, the reservation date, the collection location and the collection deadline. The email may also contain a QR code or the date and time of an event.
The User must collect the reward within the period specified in the email confirming the reservation. The standard collection period is 1–3 business days from the date of reservation, unless the rules of a particular campaign specify a different period.
Rewards may be collected only during the opening hours of the Info Point or Administration Office applicable to the relevant Shopping Centre. Users should take the collection point’s opening hours into account when making a reservation.
Once the collection deadline has passed, the reward reservation expires.
Points deducted for redeeming a reward may be manually returned to the User’s account only in exceptional, justified circumstances. A request for a refund of points must be sent to supportpl@myspot.space within 7 days of the reservation expiry date.
After this deadline, the points are permanently forfeited and cannot be refunded.
The employee handing over the reward selected by the User or granting access to an exclusive event will ask the User to scan the QR code in the Application. Once the code has been validated, the employee will hand over the reward or grant access to the event.
The Company and/or the Shopping Centres shall not be liable for the manner in which rewards are offered, supplied or handed over by Business Partners.
After collection, all rewards can be viewed in the “Points History” section.
Participation in loyalty programmes to obtain rewards does not involve any additional fees or expenses for Users.
Rewards available under the My SPOT loyalty programme and benefits received by Users based on their membership status, such as access to discounts, are available concurrently. Users decide whether to use both types of benefits under the Loyalty Programme.
11.2. Warranty and Complaints Regarding Rewards
The Programme Operator does not provide a warranty for rewards issued under the Programme. If a warranty has been provided for a product, it applies under the terms and for the period specified by the relevant store, tenant or manufacturer.
If a problem arises with a product, the Participant should report it to supportpl@myspot.space, providing information that enables the reward to be identified and describing the problem.
Complaints submitted through the Operator will be accepted only for rewards in the Electronics category and only during the warranty period applicable to the relevant product.
If a complaint is accepted, the only available remedies are replacement of the product with a new item or reimbursement of the number of points used to redeem it. The Participant is not entitled to a monetary refund or cash payment.
11.3. How to Use Discounts at Partner Stores
To receive discounts, Users must visit the relevant Business Partner directly, i.e. the store in the Shopping Centre to which the offer applies.
Before paying for the products, Users must present the store’s discount offer in the Application or show the barcode published as part of the store’s offer. The barcode will then be scanned by a store employee.
The discount will be applied directly at the checkout.
The Company and/or the Shopping Centres shall not be liable for how a discount is offered or granted by a particular Business Partner.
Participation in loyalty programmes to obtain benefits does not involve any additional fees or expenses for Users.
12. CANCELLATION OF POINTS AND ACCOUNT BLOCKING
The Shopping Centre and/or the Company’s Business Partners reserve the right to deduct points obtained by Users through fraudulent activity, for example:
Scanning copies of receipts.
Scanning receipts that were not obtained as a result of making a purchase at the Shopping Centre.
Scanning receipts from a store where the User works.
Scanning receipts and subsequently returning the purchased goods without informing the Organiser that the goods have been returned and without notifying the Organiser that the receipt should be deregistered.
If, after the deduction of points, the remaining balance is insufficient to redeem a reward, the Participant loses the right to that reward. If the reward has already been issued to the Participant, the Participant must return the reward or its equivalent value, at the Organiser’s discretion.
If a User scans a receipt displayed on the screen of another device, a photograph of a receipt, a receipt that has been altered in any way and/or superimposed on another receipt, a receipt proven not to belong to the User, or if the User exceeds the maximum limit of 2 receipts per day (the last 24 hours) and 20 receipts per week (the last 7 days), as specified in Section 3.4, the owner of the Application and/or the Company may block the User’s access to the Application.
The same applies if a User is employed by a tenant of the Shopping Centre and scans receipts issued by the same store where they are employed.
13. WITHDRAWAL AND AMENDMENTS
The Company has the right to withdraw or amend the My SPOT Loyalty Programme at any time it considers appropriate, including changing or cancelling the list of benefits and rewards available in the Application, as well as the list of stores participating in the Programme, without prior notice to or consent from the User.
14. INFORMATION AND COMPLAINTS
Users may send any questions, comments or complaints to supportpl@myspot.space.
All complaints or enquiries relating to the operation of the Loyalty Programme will be handled by the Shopping Centre within 30 days.
The complaint procedure does not affect any rights or legal remedies that may be available to consumers under applicable law.
15. OTHER INFORMATION AND TERMS OF USE
Users may create only one user account and are required to provide accurate information.
To verify the identity of a User requesting benefits under their account, the Shopping Centre may ask the User to provide proof of identity, such as an identity card, driving licence or passport.
The account is personal, and Users are prohibited from sharing their login details with other people.
The Shopping Centre reserves the right to delete an account or cancel collected points in the following cases, including where the User breaches any of the rules set out in the Terms of Use:
If points have been collected through fraudulent activity.
If points have not been redeemed within 12 months of being awarded.
Users may reset their password in accordance with the instructions provided in the Application.
Users are required to check periodically for changes to the Terms of Use and Privacy Policy.
If a User does not wish to accept the Terms of Use or Privacy Policy, including any amendments and/or additions to them, the User must stop using the Application.
16. PERSONAL DATA PROTECTION
The general legal framework governing the protection of personal data is established by Regulation (EU) 2016/679 on the protection of personal data (the “GDPR”), which applies within the European Union.
Details regarding the categories of personal data processed in connection with the use of the Application and the related information on data processing are available in the Privacy Policy.
